Complete document checklist for HR teams sponsoring an H-1B change of employer: what to collect from the candidate before LCA and I-129 filing.

From the candidate

  • Passport biographical page and any U.S. visa stamps
  • Most recent Form I-94 arrival/departure record
  • All prior H-1B I-797 approval notices
  • Recent pay stubs (typically 3–6 months from current H-1B employer)
  • Degree certificate(s) and transcripts — include credential evaluation if foreign degree
  • Updated resume and signed offer letter
  • Prior employer's job title and dates of employment (for continuity of status)

  • Detailed job description matching the offered role
  • Worksite address(es) for LCA posting
  • Salary and wage level justification
  • Federal Employer Identification Number (FEIN)
  • Signatory authority for DOL and USCIS forms
