H-1B Transfer Document Checklist for HR (Change of Employer)
Complete document checklist for HR teams sponsoring an H-1B change of employer: what to collect from the candidate before LCA and I-129 filing.
From the candidate
- Passport biographical page and any U.S. visa stamps
- Most recent Form I-94 arrival/departure record
- All prior H-1B I-797 approval notices
- Recent pay stubs (typically 3–6 months from current H-1B employer)
- Degree certificate(s) and transcripts — include credential evaluation if foreign degree
- Updated resume and signed offer letter
- Prior employer's job title and dates of employment (for continuity of status)
From the employer
- Detailed job description matching the offered role
- Worksite address(es) for LCA posting
- Salary and wage level justification
- Federal Employer Identification Number (FEIN)
- Signatory authority for DOL and USCIS forms
